DATUK LIOW: KEADILAN UNTUK #MH17 SEMAKIN HAMPIR

Di dalam usaha yang tidak henti-henti dan komitmen padu oleh kerajaan Malaysia untuk mencari kebenaran dan keadilan bagi mangsa-mangsa tragedi MH17 di timur Ukraine pada 17 Julai 2014 lalu, ia seolah-olah segala usaha kerajaan kita bersama-sama dengan Pasukan Siasatan Bersama (JIT) sedang menghampiri kejayaan untuk membawa penjenayah dan rangkaian mereka supaya mengaku bertanggungjawab dan seterusnya di bawa ke muka pengadilan.

Siasatan jenayah antarabangsa yang diketuai Belanda atau Lembaga Keselamatan Belanda (DSB) telah sebelum ini mendedahkan kesimpulan pertama mereka bahawa pesawat negara MH17 ditembak jatuh dari udara oleh 9M38 siri BUK peluru berpandu milik puak pemisah Rusia yang berkemungkinan juga adalah Persekutuan Rusia, telah membunuh kesemua 298 penumpang dan anak-anak kapal dalam penerbangan dari Amsterdam ke Kuala Lumpur.

Melalui laporan interim yang dikeluarkan oleh JIT baru-baru ini, ia sekali gus mengesahkan bahawa peluru berpandu itu dilancarkan di dalam ladang pertanian berhampiran Pervomaiskiy, sebuah bandar di Kharkiv, Ukraine Timur di mana beberapa siasatan bebas juga telah mengesahkan bangkai MH17 telah terhempas. Hasil siasatan juga menyebut bahawa kira-kira 100 individu yang telah dikenal pasti dengan beberapa kemungkinan yang boleh melibatkan angkatan tentera Rusia, Kremlin dan Vladimir Putin sendiri.

Seperti yang dinyatakan oleh Menteri Pengangkutan Dato 'Liow Tiong Lai, kerajaan Malaysia sememangnya akan terus mendesak untuk mendapatkan keadilan bersama-sama dengan rakan-rakan JIT lain iaitu, Belanda, Belgium, Ukraine dan Australia. Difahamkan juga bahawa perjanjian JIT akan dilanjutkan sehingga Januari 2018 untuk membolehkan siasatan yang berterusan.

Satu resolusi untuk menubuhkan sebuah tribunal antarabangsa melalui Majlis Keselamatan PBB telah ditolak pada Julai tahun lepas di mana 11undi telah bersetuju, tiga berkecuali (Angola, China dan Venezuela) dan seperti yang dijangka satu undi menolah yang pastinya adalah dari Persekutuan Rusia.

Sekiranya ia diluluskan, Majlis, di bawah Bab VII Piagam Pertubuhan Bangsa-Bangsa Bersatu, akan mengguna pakai Statut Tribunal Jenayah Antarabangsa bagi pesawat Malaysia Airlines MH17 dan menuntut bahawa semua Negeri dan pelakun lain menjauhkan diri daripada tindakan keganasan terhadap pesawat awam. Ia akan menyeru semua negara dan pelaku di rantau ini untuk memberikan kerjasama sepenuhnya dalam menjalankan penyiasatan antarabangsa, sebagaimana yang dikehendaki oleh resolusi 2166 (2014).

Walau bagaimanapun, usaha kerajaan Malaysia dan JIT untuk mendapatkan kelulusan Majlis Keselamatan PBB tidak menemui kegagalan sepenuhnya apabila Majlis telah meminta JIT untuk terus serta sentiasa memberi maklumat mengenai kemajuan siasatan samada hasil laporan teknikal mahupun siasatan penjenayah yang disabitkan. Oleh itu, setelah mendapat bukti yang kukuh, langkah seterusnya adalah proses pendakwaan tanpa sebarang keraguan.

Liow: A Step Closer to Bringing the Perpetrators to Justice

The interim report released by the Joint Investigation Team (JIT) for MH17 today confirmed the earlier technical report by the Dutch Safety Board (DSB) that the aircraft was undeniably hit by a surface-to-air 9M38 series BUK missile.

Furthermore, the report also concluded that the exact location of the launch site is an agricultural field near Pervomaiskiy, a city in Kharkiv, Ukraine – an area controlled by pro-Russian rebels at that time. The finding is consistent with DSB report based on material obtained from the United States and the European Space Agency.

While the report could not determine the perpetrators responsible for this tragic incident, the JIT has identified the identity of approximately 100 individuals that could be linked to the downing of MH17.

Malaysia together with our JIT partners, the Netherlands, Belgium, Ukraine and Australia have never wavered from our fight to seek justice. We laud the announcement that the JIT agreement will be extended until January 2018 to enable investigation to continue unabated.

Armed with both JIT and DSB report, Malaysia is ever more resolute to seek justice. As part of the JIT, Malaysia remains single-minded in our pursuit to prosecute those who are responsible in this unfortunate tragedy through appropriate effective prosecution mechanism.

Malaysia would like to record our gratitude to our colleagues in JIT for its detailed and transparent investigation that now enables us to move forward on a more solid ground.

During this trying time, our thoughts and prayers are with the next of kin and loved ones of the passengers and crew onboard MH17.

I have said many a times. The international community must stand united in the quest to make our skies safer. In the International Civil Aviation Organization (ICAO) 39th General Assembly yesterday, I reiterated my appeal to nations to enhance standards and strengthen international cooperation to improve safety and security in global civil aviation.

There must be mandatory timely reporting of relevant information on risks flying in conflict zones to ICAO by member states and ICAO must establish global protocol to disseminate this information to member states and airlines.

This is not optional. It will save lives.

Walaupun cubaan Malaysia dan JIT untuk mendapatkan keadilan pernah diketepikan Rusia di dalam Majlis Keselamatan PBB, yang pasti, laporan interim JIT dan pengesahan dari siasatan teknikal DSB, kita akan terus menuntut pembelaan ke atas mangsa-mangsa MH17 walaupun ia akan memakan masa lama.

DATUK LIOW : PENDAKWAAN #MH17 ADA BUKTI KUKUH

Seperti yang dijanjikan kerajaan Malaysia, laporan dari Majlis Keamanan Belanda atau Dutch Safety Board (DSB) telah dikeluarkan dan mengesahkan MH17 telah ditembak peluru berpandu BUK atau BUK surface-to-air missile. Laporan muktamad ini jelas bercanggah dan menafikan teori Rusia bahawa pesawat MH17 telah ditembak oleh jet pejuang Ukraine. Siasatan DSB juga mendapati teori alternatif lain sekiranya pesawat ini menjunam akibat daripada letupan dalaman, terkena tembakan mahupun serangan di udara.

Di dalam siaran akhbarnya, Menteri Pengangkutan Dato 'Sri Liow Tiong Lai telah menyeru untuk teruskan pendakwaan walaupun telah digagalkan dengan kuasa veto Rusia ketika dibentangkan ke Majlis Keselamatan PBB untuk menetapkan satu tribunal antarabangsa.

Ketika perjumpaan ketua-ketua negara JIT bertemu baru-baru ini di New York, Perdana Menteri Najib Razak telah bersetuju bahawa perjanjian untuk menubuhkan mahkamah bebas antarabangsa bagi mengadakan satu mekanisme pendakwaan yang lebih berkesan ke atas mereka yang bertanggungjawab. Oleh itu, tidak perlu dilengahkan lagi untuk dibicarakan penjenayah-penjenayah ini dan Malaysia bersama-sama dengan negara Belanda, Belgium, Ukraine dan Australia sentiasa berusaha untuk mencari keadilan bagi waris para penumpang dan anak kapal MH17.

Ketika laporan yang telah dibentangkan di pangkalan tentera udara Gilze-Rijen di Belanda, Pengerusi Majlis Keselamatan Belanda Tjibbe Joustra, berdiri di hadapan bahagian ketiga rangka kapal terbang yang dibina semula dari serpihan yang ditemui dari kawasan Timur Ukrain.

MH17 telah terhempas di Timur Ukraine pada 17 Julai 2014, mengorbankan kesemua 283 penumpang dan 15 anak kapal pesawat Boeing 777.

Laporan DSB juga mendedahkan ketika MH17 terhempas, kedua-dua pilot telah terbunuh serta merta tetapi penumpangnya masih hidup dalam jangkamasa seminit setengah dan pada masa yang sama, mendapati peluru berpandu BUK buatan Rusia telah dilepaskan dari beberapa meter menuju ke arah kokpit kapalterbang tersebut. Selain itu, DSB mendapati apabila arah peluru berpandu tersebut dikajisemula, ianya datang dari kawasan sekitar 320 kilometer selatan-timur Grabovo, Ukrain di mana kebanyakan kawasan tersebut dikawal pihak pemisah.

Antara lain, DSB juga menafikan beberapa lagi punca kemalangan berdasarkan analisa yang kurang tepat termasuklah punca dari anak-anak kapal, jadual penerbangan, muatan kargo dan juga sekatan ruang udara.

Bagi pihak Malaysia, Datuk Liow ingin merakamkan terima kasih kerajaan kepada DSB ke atas siasatan yang sangat teliti lagi telus dan dengan bukti-bukti yang kukuh, tiba masanya negara-negara mangsa meneruskan pendakwaan mereka. Beliau juga menyeru masyarakat antarabangsa untuk bersatu dalam usaha untuk memastikan keadaan yang lebih selamat di ruang udara dan perubahan ke atas operasi penerbangan komersial antarabangsa tidak dilengahkan.

Datuk Liow telah mencadangkan agar International Civil Aviation Organization (ICAO) perlu menguatkuasakan maklumat yang relevan mengenai risiko penerbangan dan mewujudkan protokol antarabangsa untuk menyebarkan maklumat-maklumat tersebut kepada negara-negara anggotanya serta syarikat-syarikat penerbangan di mana ia mampu menyelamatkan nyawa manusia.

Pada masa yang sama, dilaporkan Datuk Sri Najib Razak juga menyeru agar negara-negara mangsa bekerjasama membawa mereka yang bertanggungjawab ke atas 'pembunuhan' ini ke muka pengadilan dan menganggap ia sebagai serangan yang tidak sepatutnya berlaku. Walaupun telah melangkaui lima belas bulan, komitmen Malaysia untuk mendakwa pelaku-pelaku ini masih utuh sebagaimana ketika hari tragedi yang mengorbankan beratus nyawa mangsa yang tidak berdosa di dalam konflik yang mereka tidak terlibat.

ULANG TAHUN #MH17 : LIOW AKAN PASTIKAN KEBENARAN DITEGAKKAN

Majlis memperingati ulang tahun tragedi MH17 telah berlangsung di Kompleks Bunga Raya KLIA pada 11 Julai lalu dan dihadiri waris serta anggota keluarga mangsa. Ulang tahun bagi tanda penghormatan kepada mangsa yang terkorban ini juga telah dihadiri para menteri yang diketuai Perdana Menteri Datuk Seri Najib Tun Razak dan isteri Datin Seri Rosmah Mansor, Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin dan isteri, Puan Sri Noorainee Abdul Rahman.

Penerbangan MH17 telah ditembak jatuh ketika melalui ruang udara Ukraine pada 17 Julai tahun lepas yang telah mengorbankan kesemua 298 penumpang dan anak kapalnya di mana di antaranya adalah 43 rakyat Malaysia.

Di dalam kenyataan Datuk Seri Liow Tiong Lai selaku Menteri Pengangkutan bertekad bahawa kerajaan Malaysia akan terus menggesa masyarakat antarabangsa bertindak tegas mencari dan membawa mereka yang bertanggungjawab ke muka pengadilan bagi menegakkan kebenaran. Oleh itu, Datuk Liow menyeru agar semua negara mematuhi protokol di dalam proses membuat laporan dan tidak wujud halangan di dalam mencari kebenaran.

Kerajaan Malaysia tetap komited untuk mencari jawapan kebenaran kepada para waris mangsa tragedi tersebut walaupun mengetahui ia bukanlah sesuatu yang mudah dan Datuk Liow memaklumkan yang mereka tidak pernah keseorangan di dalam mencari jawapan tersebut.

Di antara perkembangan yang menggalakkan adalah draf laporan akhir siasatan diberikan kepada semua negara terlibat oleh Lembaga Keselamatan Belanda (DSB) di mana merekalah yang mengetuai kumpulan penyiasatan teknikal. Laporan rasmi dijangka akan dikeluarkan pada bulan Oktober tahun ini.

Bagi pihak Malaysia pula, satu pasukan telah ditubuhkan untuk menyemak laporan tersebut dan para waris mangsa akan dimaklumkan tentang perkembangan dan hasil siasatan itu pada waktu yang sesuai.

Malaysia adalah sebahagian daripada majlis 15 anggota Majlis Keselamatan Pertubuhan Bangsa Bersatu (UNSC), juga telah mendesak agar satu tribunal antarabangsa ditubuhkan dan pihak negara telah mengemukakan satu draf resolusi di mana telah mendapat sokongan penuh dari negara Belanda, Australia, Belgium dan Ukraine. Draf resolusi berkenaan akan diedarkan awal minggu ini dan kita berada di landasan betul mengambil langkah ini.

Samada negara Rusia akan menggunakan kuasa veto mereka untuk menyekat resolusi itu di UNSC, Datuk Liow berpandangan agar resolusi tersebut dibentangkan terlebih dahulu sebelum membuat sebarang penghakiman kerana laporan teknikal ini adalah terperinci dan mampu mengesan siapakah pelakunya dan penjenayah tersebut semestinya dibawa ke muka pengadilan.

#MH17 : DATO WEE KA SIONG IS THE MAN INCHARGE TO ENSURE ALL REQUESTS FULLFILLED

It seems that questioning, doubting and what more belittling  every effort from government that crops from certain quarters are seen as normal and obligatory these days.

At a time when the whole world shared their sympathies and mourned for MH17 victims, these quarters went to the extent that is incomprehensible questioning that government spent too lavish preparing for victims of the ill-fated  MH17 funeral rites and the ceremony at Kuala Lumpur International Airport. 

For God sake, the ceremony was so solemn and should any of us watched its live telecast, ask ourselves these questions - Did anyone seen a scene of lively parade floats?

Were there any luxury food served? The remains were carried by luxury transports? And is it a waste of tax payers money to broadcast them live?

Dato Wee Ka Siong, the minister incharged shared his experience. 

He felt honored when entrusted by our Prime Minister not only due to his obligation but with cautious that this is a heartbreaking tragedy involves mixed feelings of grieve, agony and you just name it. Dato Wee is the men given the responsibility  in ensuring smooth process of bringing back the remains of Malaysians. 

Finally, a respectful homage granted from our government and  accorded with military honours.

Arrangements identifying  the victims' remains are all done in Amsterdam and we must  understand that the procedures and regulations in the Netherlands are rigorous.

Netherlands is one country that complies to stringent working hours. Despite all that, Dato Wee managed to get them handled smoothly when first, second and third batch

with a total of 33  were successfully delivered  home and 10 more are still unidentified.

The remains of Malaysian victims had to go through five important processes. These included obtaining the death certificate, medical certificate, disaster report, approval permit for delivery of the body and the letter from the Dutch public prosecution officer allowing the remains to be buried or cremated.

No matter how rigorous the process could be, Dato Wee admitted that this process were simplified with unconditional assistance from the Interfaith Council which sent representatives to Amsterdam, as well as local religious bodies and from abroad. NGOs and religious associations in Malaysia including MCA has managed to get contacts abroad for non-Muslim funeral. Monks, priests and other religious leaders were brought to meet victims' families and as far as the government is concerned, all their

requests are fulfilled.

For Buddhists, Fo Guang associaton who has a worldwide network has given their full assistance and infact there are monks from Taiwan, Thailand and Tibet who offered their help. Protestants and Catholics worked along for Christian Community in Amersterdam  and  to the heirs of the victims of Sikh descent, a religious leader took care of the cremation process.

Above all, Dato Wee praised JAKIM's officers who have shown their full commitment without compromising any hours, so be it in the middle of the night that they perform

prayers for Muslim victims.

What matters most to Dato Wee is that the victims' families appreciated the hardwork and they even cited that the remains laid to rest are beyond their expectations where it was done perfectly. Dato Wee personally ensures that all from A to Z are to be given at its best for the families.

When asked on dissenting voices from certain quarters especially from opposition leaders who accused that the government is spending lavishly on the occassion, Dato Wee

regards them as so unfounded. We need the aircraft to fly the coffins and urns, the military presence is only for ceremonial honor and those hearses will still be used again. As for the existing Kompleks Bunga Raya, the newly constructed wing were open for the occassion.

Should there be any incurred additional costs would be rental for tents and chairs. Infact no meals were served. Media coverage were born by their respective companies. Therefore, this clearly proven that any accusation our government were spendthrift is utterly not true.

Flight MH17 crashed in eastern Ukraine on July 17 as it was flying from Amsterdam to Kuala Lumpur with 283 passengers and 15 crew on board. The Boeing 777-200 aircraft is believed to have been shot down over the troubled country between eastern Ukarine and pro-Russian separatists.

PRIDE AND NO PREJUDICE ON OUR NATIONAL CARRIER - MAS

MAS is ailing in its ringgit.  The airline reported losses of RM443.4 million in the first quarter of the year, from a net loss of RM278.8 million in the same period last year. Losses in 2013 amounted to RM1.17 billion. The stock is currently trading at 22 sen.

The stumbling block to reform in MAS is MAS Employees Union of Peninsular Malaysia (Maseu), the largest union in MAS. Is this true? Even our former PM supported this view... HERE.

The gist of PM's message : 

"It involves painful steps and sacrifices from all parties. All parties should close ranks and work closely. That comprises of management, employees, unions, creditors, vendors and above all the Malaysian people especially loyal passengers."

Other than that, here is the summary to PM's statement;

PRIME MINISTER NAJIB RAZAK’S STATEMENT
ON MALAYSIA AIRLINES DE-LISTING
 
“Today, the Government of Malaysia, through its strategic investment fund Khazanah Nasional Berhad (Khazanah), announced a formal process to take full
ownership and de-list Malaysian Airline System Berhad (MAS). This is the first step needed to return our national carrier to profitability. It is a step I wholeheartedly support.
 
“MAS is part of Malaysia’s history. It is a symbol of national pride, of our ambitions and our place in the world. It is more than just a company to us. So today we are making changes to ensure it is also part of Malaysia’s future story.
 
“Like all Malaysians, I am deeply saddened by the losses of MH370 and MH17. Seldom before has a company been subjected to two profound and extraordinary tragedies in such a short space of time. We pay tribute to the victims; we pray for their families; and we thank all those around the world for their support and their prayers in these difficult times.
 
“We hope these twin tragedies will change the way the aviation industry operates, making global travel safer for all. But we must also acknowledge that they will change the way MAS operates, too.
 
“We believe our national carrier must be renewed. This means wholesale change, to deliver a wholly different outcome. Only through a complete overhaul of the company can we deliver a genuinely strong and sustainable national carrier. Piecemeal changes will not work.
 
“This process of renewal will involve painful steps and sacrifices from all parties. My instruction and my commitment to all concerned is that the process will be carried out professionally, with proper principles of fairness, transparency and compassion.
 
“It is therefore critical that all parties close ranks and work closely together. Without the full support of all parties – management, employees, unions, creditors and vendors – as well as loyal passengers and the Malaysian people – this restructuring will not succeed.
 
“The Government and Khazanah are in the final stages of completing a comprehensive and holistic restructuring plan. With due process and following the relevant approvals, we expect that a detailed plan will be announced before the end of August.
 
“MAS is our national carrier, and our national pride. The changes that start today will lay the foundations for its future success. I ask that all Malaysians continue to support Malaysia Airlines, as we build a stronger and more sustainable national carrier.”

#MH17 : MALAYSIA IS IN MOURNING TOO

Ladies and gentlemen,

Like the Netherlands, Malaysia is in mourning. We mourn the loss of all 298 lives on board MH17.

And as we watched the first bodies arrive in Eindhoven, our hearts reached out to the people of the Netherlands, who have lost so much.

The flags flying at half-mast told their own story: of the nations who lost their sons and daughters. And of our determination to work together to bring them home.

Malaysia stands with the Netherlands, with Australia; with all countries whose people have been lost. We stand together, united in grief, and ready to help however we can.

Earlier, Prime Minister Rutte and I spoke about the continued military activity at the crash site; the inability of international investigators to deploy across it; and the human remains that may still lie there.

For the sake of the grieving families, it is imperative that all remains at the crash site are repatriated as soon as possible. Every single victim must be given dignity and a decent funeral.

Our other priority is to ensure the international investigators are given full and unfettered access to the site, so that they may collect evidence and carry out their vital work. Only then will we be able to find out what happened to MH17; only then can we achieve justice for the victims and their families.

The conflict in Eastern Ukraine may not be easily resolved. But the people on board that plane had no part in it.

We ask that there be an immediate cessation of hostilities in and around the crash site – by both Ukrainian and separatist forces.

We ask that all sides respect the lives lost, and the integrity of the site, so that the investigation may proceed. The long walk towards justice begins with this step.

A team of 68 Malaysian police has arrived Kiev today. They will work together with the Dutch and Australian teams to help secure access to the site.

Malaysia fully supports the international investigation, and we are grateful to the Netherlands for their lead role in the international team.

Repatriating the remains of victims as fast as possible is a shared priority. Malaysian experts are already helping here in the Netherlands with the painstaking task of identification – and we stand ready to provide more assistance if required.

On behalf of Malaysia, I would like to thank Prime Minister Rutte and the Dutch people for all they have done, and continue to do, for the victims of this senseless and tragic act.

#MH17 : AGREEMENT REACHED NEED TO BE HONOURED

PRIME MINISTER NAJIB RAZAK STATEMENT ON MH17 AGREEMENT

In recent days, we have been working behind the scenes to establish contact with those in charge of the MH17 crash site.

That contact has now been made. Under difficult and fluid circumstances, we have been discussing the problems that have occupied us all: securing vital evidence from the aircraft, launching an independent investigation, and above all recovering the remains of those who lost their lives.

Tonight, we have established the basis of an agreement to do just that.

Alexander Borodai is known as the "prime minister" of the self-proclaimed Donetsk People's Republic

Earlier this evening I spoke to Alexander Borodai, who is in command of the region where the tragedy occurred. We have agreed the following: 

· Firstly, the remains of 282 people, currently in Torez, will be moved by train to Kharkiv, where they will be handed over to representatives from the Netherlands. The train will depart this evening Ukraine time, and will be accompanied by six Malaysian members of the recovery team. The remains will then be flown to Amsterdam on board a Dutch C130 Hercules, together with the Malaysian team. Following any necessary forensic work, the remains of Malaysian citizens will then be flown home to Malaysia.

Separatist rebels believe they have recovered black box recorders from MH17 wreckage

· Secondly, at approximately 9pm tonight Ukraine time, the two black boxes will be handed over to a Malaysian team in Donetsk, who will take custody of them.

· Thirdly, independent international investigators will be guaranteed safe access to the crash site to begin a full investigation of the incident.

I must stress that although agreement has been reached, there remain a number of steps required before it is completed.

There is work still to be done, work which relies on continued communication in good faith. Mr Borodai and his people have so far given their co-operation.

I ask that all parties continue to work together to ensure that this agreement is honoured; that the remains of our people are returned, that the black box is handed over, and that the international team is granted full access to the site.

Only then can the investigation into MH17 truly begin; only then can the victims be afforded the respect they deserve. We need to know what caused the plane to crash, and who was responsible for it, so that justice may be done.

In recent days, there were times I wanted to give greater voice to the anger and grief that the Malaysian people feel. And that I feel. But sometimes, we must work quietly in the service of a better outcome.

I understand that for the families, nothing can undo this damage. The lives taken cannot be given back; the dignity lost cannot be regained.

My heart reaches out to those whose loved ones were lost on MH17. We hope and pray that the agreement reached tonight helps bring them a clear step towards closure.

MH17 tragedy in Ukraine-Russian border is beyond anyone comprehension and the world would never expect to happen.

This horrific accident gained many sympathies around the world, from world leaders and world medias including world religion organisations. No words of crticism from them except prayers and sympathies. Unfortunately, some opposition lawmakers in Malaysia and opposition youth leader who was not only with DS Najib to face this problem, but heartlessly in their usual manner incite Malaysians disputing what happened and blamed MAS.

These are prayers and sympathies from all walks of nations despite race, country and religions;

And this comment to Kor Ming clearly stated that rakyat had enough of your insensitivity even at the point when the whole world grieved and saddened by the tragedy... ;

To Kor Ming, if you couldnt be part of the solution, lets not be part of the problem!

Yes! You are not fit to represent them!
